Caught Driving Without a Licence in NZ? Here’s What to Do

It might feel minor, but driving without a licence in New Zealand can carry real consequences: fines, disqualification, a criminal conviction, and even jail time for repeat offences.

What Does “Driving Without a Licence” Actually Mean?

You can be charged with driving without a licence in NZ if:

  • You never held a driver’s licence

  • You let your licence expire and didn’t renew it

  • You were driving on a learner/restricted licence and broke the conditions

  • You were disqualified or suspended and ignored it

  • You had a foreign licence but it was no longer valid in NZ

What Are the Penalties?

Here’s a general guide to what you could face:

Driving while never licensed / expired licence

  • Fine up to $1,000

  • No disqualification (usually)

  • May still be recorded as a criminal offence

Driving while disqualified

  • Up to 3 months imprisonment

  • Fine up to $4,500

  • Mandatory disqualification for 6+ months

  • May lead to court-ordered vehicle confiscation or impoundment

Repeat offences

  • Harsher sentencing

  • Increased likelihood of jail, especially with aggravating factors (e.g. driving dangerously while unlicensed)
